Terms & Conditions

These terms govern your access to and use of Nonto. Please read them carefully. By creating an account or using the service you agree to be bound by them.

1. Service

Nonto is a web-based invoicing tool that lets freelancers and small businesses create, send and track invoices, manage client records, and store related business data (the “Service”).

Nonto is not a tax-advisory, accounting, legal or banking service. Output produced by the Service does not constitute professional advice and you remain responsible for verifying that your invoices comply with the laws of the jurisdiction in which you operate.

2. Eligibility & account

  • You must be at least 18 years old and legally capable of entering into a binding contract.
  • You may use the Service as an individual freelancer or on behalf of a legal entity you are authorised to represent.
  • Authentication uses one-time codes sent to your email address. You are responsible for keeping access to that mailbox secure.
  • You must provide accurate registration and business details and keep them current.
  • You may not share, transfer or resell your account.

3. Your content & ownership

Data you enter into the Service — including your business profile, clients, invoices and attachments (“Your Content”) — remains yours. You grant Nonto a limited, worldwide, non-exclusive licence to host, process and display Your Content solely to provide the Service to you.

You are solely responsible for the accuracy and legality of Your Content, including ensuring you have a lawful basis to process the personal data of any clients you add. See our Privacy Policy for our role as processor of such data.

4. Acceptable use

You agree not to:

  • Use the Service for fraudulent invoicing, money laundering, tax evasion or any unlawful purpose.
  • Upload content that is illegal, infringes third-party rights, contains malware or harms others.
  • Reverse-engineer, scrape, overload or interfere with the Service or its infrastructure.
  • Circumvent authentication, rate limits or access controls.
  • Use the Service to send unsolicited commercial communications to your clients in breach of applicable law.

We may suspend or terminate accounts that violate these rules. Where required by the Digital Services Act, we will give you a statement of reasons and an opportunity to contest the decision via hello@sunday.engineering.

5. Plans, billing & trial

Some features may be offered free of charge and others on a paid plan. Pricing, billing cycle, accepted payment methods and any trial conditions are presented at the point of purchase and form part of these terms when you subscribe.

Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. You can cancel at any time from your account settings; cancellation takes effect at the end of the current paid period and no pro-rata refund is issued for unused time, except where required by law.

6. Right of withdrawal (consumers)

If you are a consumer in the EU/EEA, you have the right to withdraw from the contract within 14 days of acceptance without giving any reason, under Directive 2011/83/EU.

To exercise this right, send an unambiguous statement to hello@sunday.engineering before the 14-day period expires. You may use a plain email; no specific form is required.

Loss of withdrawal right. By starting to use paid features before the 14-day period ends, you expressly request that performance begin immediately and acknowledge that you lose the right of withdrawal once the Service has been fully performed. For partial performance you owe a pro-rata amount for the period used.

7. Switching & data export (EU Data Act)

You can export your invoices and client records at any time from within the Service in commonly used, machine-readable formats. In line with Regulation (EU) 2023/2854 (the EU Data Act), you may terminate the contract and switch to another provider with a maximum notice period of two months. We will assist with extraction of your data during this period.

8. Changes to the Service and these terms

We may modify the Service to improve it, fix issues or comply with law. We may also amend these terms. Where a change is significant we will notify you by email or in-app notice at least 30 days before it takes effect. Continued use of the Service after the notice period constitutes acceptance. If you do not accept the changes, you may terminate your account before they take effect.

9. Availability & warranties

We work hard to keep the Service available and secure but do not guarantee uninterrupted, error-free or completely secure operation. To the maximum extent permitted by law, the Service is provided “as is”. Mandatory consumer warranties under your local law are not affected.

10. Liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or in connection with these terms is limited to the fees you paid for the Service in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, punitive or consequential damages, or for lost profits, revenue, goodwill or data.

Nothing in these terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or — where you are a consumer — liability for breach of mandatory consumer protection rights.

11. Termination

You may close your account at any time from settings. We may suspend or terminate your account for material breach of these terms, fraudulent activity, or non-payment, with reasonable notice except in cases of serious or repeated breach. On termination, we will delete or anonymise your personal data in accordance with our Privacy Policy.

12. Governing law & disputes

These terms are governed by the laws of the Republic of Lithuania, without prejudice to mandatory consumer protection rules of the country in which you have your habitual residence. Disputes are subject to the non-exclusive jurisdiction of the courts of the Republic of Lithuania.

If you are a consumer you may also submit disputes to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
